Legal Research Guides by Course - Art of Mediation: Theory and Practice

Course Description

Mediation is becoming part of the legal process in civil and family cases, with courts and legislatures increasingly mandating alternative dispute resolution prior to trial. The goals of mediation are to save time, expense, and stress of a trial, protect the parties' privacy and autonomy, and, in family cases, protecting children from the adversarial process. This course explores history and theory of conflict management and provides practical training in mediation for students considering this field of practice or for others desiring improved negotiation skills. Students will participate in a variety of role play scenarios that build practice skills and techniques. The course in combination with Family Law is approved by the Association for Conflict Resolution and satisfies the requirement of the Pennsylvania Supreme Court (Pa R.C.P. 1940.4) as the training standard for court-appointed family mediators. Students successfully completing the course will receive a Certificate in basic mediation training. Course is graded Pass/Fail. (2 credits)
