Course Description

Aviation and airplanes are essential tools for facilitating commerce, communications, and international relations between nations. For many nations, aviation is a symbol of national pride, prestige, and global integration. This class will introduce modern aviation law in its main forms: international treaties, air transport agreements, key case law, international dispute resolution between nations, and significant principles of U.S. domestic law. We will explore The Chicago Convention of 1944 and how it continues to shape aviation of the rights of nations in international flights. We will discuss the International Civil Aviation Organization and its role in air safety, aviation security, ensuring sovereignty of a nation's airspace, commercial air traffic routes, and liability. We will also discuss the regulatory schemes of the U.S. Federal Aviation Administration and Department of Transportation, and the U.S. legislative response to international terrorism before and after 9-11. We will analyze the legal issues surrounding aviation and the environment, airport construction, aviation insurance, and aircraft accident litigation in the U.S. courts. (2 credits)
