Recent Developments in Consitutional Law

This session will be devoted to a consideration of many of the U.S. Supreme Court's most significant constitutional decisions of the past year, and of the most important constitutional cases now pending before the Court.

Religion, Secularism, and Morality

Presenter: Professor Bruce Ledewitz

Scalia quote: "this has nothing to do with making you better lawyers but everything to do with making you better persons."

The CLE will examine the uneasy relationship among secularism, religion and morality in law, the theory of law, the practice of law and education in law. In his Centennial Address at Duquesne Law School in September, 2011, Justice Antonin Scalia said that faith and morals are vital parts of any educational institution. But he added, "This has nothing to do with making students better lawyers, but everything to do with making them better men and women." The CLE will examine this claimed distinction. The first hour will chart the possible future development of Establishment Clause jurisprudence based on the Symposium event on that subject held in November at Duquesne Law School. The second hour will explore proposals to blur the religion/non-religion distinction in different contexts in constitutional law. Finally, the last hour will examine legal education from the perspective of Justice Scalia's distinction between morality and law. What is the role, if any, of religion in any law school's program? Is that question the same or different from asking about the role of morality in any law school's program?

"1911 Bar Exam and What it is to be a Lawyer" (LP)

Presenter: Professor Mark D. Yochum

This exploration of the PA 1911 Bar Examination will review this old test to reveal the changing nature of the practice of law, over the past 100 years. The examination of the exam will reveal that which was important then and what it meant to be a lawyer. One can wonder whether it is the same now. (LP refers to Long Play: we will look at almost the entire test; bluebooks will be provided!)

Secured Transactions

Presenter: Professor Nick S. Fisfis

This CLE is concerned with aspects of security in personal property. Covered are problems and legal principles relevant to the creation of the security interest, to its perfection, to priorities between competing security interests and between a security interest and other kinds of property interests. The emphasis will be on Article 9 of the Uniform Commercial Code (UCC) and on interrelationships between the UCC and federal bankruptcy law.
